Welcome to The Gastronome’s Guide

The Gastronome’s Guide is a restaurant guide service provided by FAD Publishing, designed for creating, sharing, and viewing content related to restaurants in India. By using The Gastronome’s Guide App and Website (collectively referred to as the “Service”), you agree to these Terms & Conditions (“Terms”). Please read them carefully.

By accepting these Terms during the sign-up process—by clicking “I agree”—or by using the Service in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Service. Your use of the Service is also subject to The Gastronome’s Guide Privacy Policy.

Only individuals aged 18 or older may use the Service.

These Terms form an agreement between you (the “User”) and The Gastronome’s Guide, not with Apple Inc. or Google LLC. You acknowledge that Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple and Google have the right to enforce these Terms against you as third-party beneficiaries.

In these Terms, “You” and “User” refer to all individuals using the Service, including you.

Definitions
The Gastronome’s Guide App: A digital application available for download on the App Store and Google Play, intended for creating, sharing, and viewing content related to restaurants.

The Gastronome’s Guide Website: A browser-based platform provided by The Gastronome’s Guide for the same purposes.

Use of the Service
We establish the rules governing the use of the Service and may update them at our discretion. We are not obligated to retain any materials or information uploaded by Users. Neither Apple nor Google is responsible for providing maintenance or support services for The Gastronome’s Guide App.
To fully benefit from the Service, you may need to install security and other updates as required by The Gastronome’s Guide. We are not liable for any errors or issues in the Service resulting from your failure to install such updates.

Account Registration
When creating an account, you must provide accurate and up-to-date information as requested during sign-up. Your account and password are personal to you. Do not share your password or allow third parties to access your account. You are responsible for all activity under your account.

User Content
You and other Users may submit content—such as text, photographs, or other data (“User Content”)—to the Service. Intellectual property rights in User Content remain with the submitting User. By submitting User Content, you grant The Gastronome’s Guide an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license to use, store, and reproduce it for any purpose, including compiling it into a guide for sale.
You are solely responsible for the User Content you submit and must ensure you have all necessary rights to upload it. Your content must not infringe third-party intellectual property rights, violate applicable laws, or be illegal, offensive, threatening, defamatory, or otherwise inappropriate. We reserve the right to remove any User Content at our discretion.

Data Collection
We may collect and process data, including personal data (e.g., contact details and identification), related to your subscription and use of the Service. Such data is handled in accordance with our Privacy Policy, as updated from time to time.

Information Disclaimer
Content uploaded by Users and other information on the Service is for informational purposes only and does not constitute professional advice. It may contain errors, inaccuracies, or material you find objectionable. We do not guarantee the accuracy, reliability, or fitness of this information for any purpose. The Gastronome’s Guide is not a party to disputes between Users and has no obligation to intervene in such matters.

Usage Restrictions
You may use the Service only as permitted by these Terms and for the purposes outlined herein. When using The Gastronome’s Guide App, you must also comply with applicable third-party terms (e.g., App Store or Google Play policies). Some features or content may be provided by third parties and are subject to their terms, not ours.

Intellectual Property
All intellectual property rights in the Service, including data generated by the Service or its use (e.g., feedback or suggestions), belong exclusively to The Gastronome’s Guide.

Service Availability
We strive to maintain the Service but do not guarantee uninterrupted access. The Service may be temporarily interrupted, permanently discontinued, or contain errors. We are not liable for damages caused by such interruptions, errors, or your use of the Service.

Limitation of Liability
To the fullest extent permitted by law, The Gastronome’s Guide is not liable for indirect, incidental, consequential, or similar damages—including loss of revenue, profits, data, or business interruption—arising from this Agreement or the Service.

Agreement Duration and Termination
This Agreement takes effect once you complete registration and accept these Terms. You may terminate your subscription and this Agreement at any time via the App Store or Google Play.
We may amend these Terms or our pricing in response to legal, technical, or business changes. Updates will be posted on The Gastronome’s Guide Website and/or App, and registered Users will be notified via email to the address provided during sign-up.

Entire Agreement
These Terms, along with our Privacy Policy and any referenced documents, constitute the full agreement between you and The Gastronome’s Guide, superseding all prior understandings related to the Service.

Applicable Law and Dispute Resolution
This Agreement is governed by the laws of Goa, India, excluding its conflict-of-law provisions.
